Renunciation of Indian Citizenship Certificate

Renunciation of Indian Citizenship

It is mandatory for all persons of Indian origin, who had ever held an Indian passport, to renounce their Indian citizenship upon acquiring any foreign nationality. This is a prerequisite to obtain Visas or OCI cards from the Consulate. 

All applications for Renunciation of Indian Citizenship for issue of Surrender of Indian Citizenship Certificate should be submitted to Cox & Kings Global Services, 10/F, 19 South La Salle St,Suite 1003, Chicago, IL 60603.  All applications received by CKGS Ltd are acknowledged by the next working day. Normal processing time for issue of a Surrender Certificate is 3-6 days.  Applicants can simulatenously apply for Renunciation Certificate while applying for Visas or OCI Cards.

All naturalized US citizens of Indian origin, who have already acquired foreign citizenship voluntarily in the past shall cease to be Indian citizens upon their acquiring foreign citizenship. However, such persons are required to renounce their Indian citizenship and obtain a “Surrender Certificate” for their Indian passports, whether valid or expired.

If the Indian passport has already been stamped as ‘Cancelled’ subsequent to acquisition of US/foreign citizenship, there is no penalty for acquiring ‘Surrender Certificate’ in case the same has not been obtained earlier.

In the event of loss of previously held passport, ‘Deemed Surrender Indian Citizenship Certificate’ could be issued subject to submission of an Affidavit for loss of passport, Police Report and a copy of the lost Indian passport, if any. In case the applicant has neither passport nor a photocopy thereof, he/she should bring originals as well as photocopies of the supporting documents such as educational certificates, birth certificate, PAN number, ration card etc., along with visa application or OCI application or stand alone, as the case may be, to the Consulate for verification by the officer concerned.

Those who acquired foreign nationality prior to 2005 and their Indian passports expired prior to 1/1/2005 are not required to pay any penalty except for normal fee of US $ 28/-.

Those who acquired foreign nationality prior to June 1, 2010 and their Indian passports were either cancelled or valid for less than 3 years as on June 1, 2010 are not required to pay any penalty except for normal fee of US $ 28/-.

Those who acquired foreign nationality prior to June 1, 2010 and their Indian passports were not  cancelled and valid for more than 3 years at the time of acquiring the foreign nationality are liable to pay a penalty of US 250/- in addition to normal fee of US $ 28/-.

Those who acquired foreign nationality after June 1, 2010 and their Indian passports were valid for less than 3 years at the time of acquiring the foreign nationality are required to pay a fee of US $ 178/-.

Those who acquired foreign nationality after June 1, 2010 and their Indian passports were valid for more than 3 years at the time of acquiring the foreign nationality are liable to pay a penalty of US 250/- in addition to normal fee of US $ 178/-.

Please note that use of Indian passport after acquiring foreign nationality is illegal and would attract a penalty of US 500/- in addition to the penalty which the competent authority may determine on case to case basis.
